IIAs must specify not only their geographical and temporal coverage, but, most importantly, their subject-matter coverage. This is done primarily through the definitions of the terms “investment” and “investor”, which form the main focus of this paper. The definition of “investment” determines economic interests, to which governments extend substantive IIA protections, while the definition of “investor” specifies the range of individuals and legal entities that can benefit from the treaty.

Titre : The Emperor’s New Clothes : Why rich countries want a WTO investment agreement Type de document : document électronique Editeur : Oxfam UK Année de publication : April 2003 Collection : Oxfam Briefing Paper num. 46 Importance : 43 p Langues : Anglais (eng) Catégories : OMC Tags : OMC Investissements UE Pays en développement Politique de développement IDE Index. décimale : 03.02 Accords Commerciaux Résumé : Despite an overcrowded agenda and the lack of progress on matters crucial to development, rich countries, especially members of the European Union, are pushing for the launch of investment negotiations at the ministerial meeting of the World Trade Organisation in Cancun in September 2003. When properly regulated, foreign investment can contribute to sustainable development. However, the proposed WTO agreement on investment will establish rules that developing countries do not need and cannot afford, enhancing investors’‘rights’ while undermining governments’ capacity to pursue pro-development policies. This is why Oxfam calls on WTO members to reject the launch of investment negotiations in Cancun. Titre : The General Agreement on Tariffs and Trade, environmental protection and sustainable development Type de document : texte imprimé Auteurs : Charles Arden-Clarke, Auteur Editeur : WWF Année de publication : 1991 Importance : 33 p Note générale : 03.02 ARD Langues : Anglais (eng) Catégories : Accords commerciaux Tags : Commerce mondial GATT Commerce des services Libéralisation Environnement Index. décimale : 03.02 Accords Commerciaux Résumé : The environmental impacts and consumption of natural resources stemming from the production of goods are rarely fully accounted for in the goods' market prices. The costs of these impacts are said to be "rcternalized". International trade generates adverse impacts on the environment and natural ressources largely as a result of the externalization of these costs at the production stage. Titre : The new Protectionism : protecting the future against free trade Type de document : texte imprimé Auteurs : Tim Lang, Auteur ; Colin Hines, Auteur Editeur : London : Earthscan Année de publication : 1993 Importance : 184 p Langues : Anglais (eng) Catégories : Accords commerciaux Tags : Commerce mondial GATT Commerce des services Libéralisation Protectionnisme Index. décimale : 03.02 Accords Commerciaux Résumé : This monograph questions the benefits of free trade, arguing that, far from promoting prosperity for all those involved, free trade only serves a narrow range of interests, primarily for the large corporations who conduct it. The authors claim that the consequences of present arrangements and those promised under the new GATT agreement will increase the difference between the world's rich and poor and accelerate the destruction of the global environment. The authors suggest instead that trading arrangements should emphasize regional self-sufficiency and the overall amount of trade should be reduced.
